Privacy, Declaration and Authority to Represent

This notice applies to Hooker & Heijden Pty Ltd as trustee for the Hooker & Heijden Unit Trust (ABN 67 481 937 878) in Australia, and Hooker & Heijden NZ Limited (NZBN 9429042459460, company number 6050814) in New Zealand (together "Hooker & Heijden", "we", "us").

We handle your personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles in Australia, and the Privacy Act 2020 (NZ) and the Information Privacy Principles in New Zealand.

Registering with us

Candidates register with us using our Australian or New Zealand Candidate Registration form. If you apply for one of our roles through SEEK or another job board, or we identify your profile through a job board's candidate search (such as SEEK Talent Search), we receive your details from that site and then contact you and send you our registration form.

When you submit a registration form, you:

confirm you have read and agree to this notice, and consent to Hooker & Heijden collecting, storing and using your personal information as described in it (required)
give Hooker & Heijden authority to represent you, as set out in the Authority to Represent section below
make the Candidate Declaration below

Both registration forms also ask for your optional consent to receive marketing communications. The Australian registration form also asks for your optional consent to be added to Elevator Pitch. Candidates who register with us in New Zealand are not added to Elevator Pitch.

You can register without giving any optional consent, and you can withdraw any consent at any time (see Withdrawing consent below).

What we collect

We may collect:

your name and contact details
your suburb, state or region, and country
your resumé, work history, current employer and job title
your skills, qualifications and LinkedIn profile
your salary expectations and work rights
referee details, interview notes and assessment results

On the registration form, we also ask about your availability, anything affecting your ability to perform the role you're seeking, criminal convictions, relevant civil proceedings, bankruptcy and regulatory disqualifications. We ask this only where it's relevant to assessing your suitability for roles in insurance, financial services and legal. You don't need to disclose spent convictions (Australia) or convictions covered by the Criminal Records (Clean Slate) Act 2004 (NZ).

With your consent, we may collect sensitive information where it's relevant to a role, such as health information or criminal record checks.

We usually collect information directly from you. We may also collect it from job boards (such as SEEK), professional networking sites (such as LinkedIn), your referees, prospective employers, and education or professional bodies.

How we use it

We use your personal information to:

consider your applications for roles we advertise
match your skills and experience with suitable opportunities, and represent you to prospective employers
contact your referees and verify your qualifications, memberships and work rights
send you job opportunities, industry news, events and updates, if you've given marketing consent on the registration form
share your details with Elevator Pitch so it can create a profile for you, if you're registering in Australia and have given Elevator Pitch consent
meet our legal obligations and run our business

We won't use your information for purposes unrelated to these without your consent, unless the law permits or requires it.

Automated tools

We use software, including AI-assisted tools, to help sort applications, match candidates to roles and prepare candidate summaries and Elevator Pitch profiles. A consultant reviews these outputs, and decisions about representing you to an employer are made by people.

Who we share it with

We may share your personal information with:

prospective employers and clients who are recruiting for, or considering you for, a role
your referees, and education, training or professional bodies, to verify your details
Elevator Pitch (myelevatorpitch.com.au), if you're registering in Australia and have given Elevator Pitch consent (see Elevator Pitch below)
service providers who help us run our business, such as recruitment database, CRM, email, cloud storage and background-check providers, who must protect your information
a buyer, merger partner or their advisers if Hooker & Heijden is sold or restructured. We'll notify you if this happens.
government agencies or others where the law requires or permits it

Where your information is stored

We store your personal information in Australia and the United States, using service providers such as our recruitment database, CRM, email and cloud storage providers. These providers act on our instructions and are contractually required to protect your information.

Our Australian and New Zealand entities may share your information with each other, and with clients in either country, where you're being considered for a role there. We remain responsible for your information wherever it's held.

Elevator Pitch (Australian candidates only)

Elevator Pitch (myelevatorpitch.com.au) is an employment platform operated by a related entity of Hooker & Heijden: the two businesses share a common shareholder. On Elevator Pitch, professionals are paid connection fees for conversations with employers, and a sign-on bonus if they're hired by a connected employer.

If you're registering in Australia and give Elevator Pitch consent on the registration form, we'll share the following with Elevator Pitch:

your full name and email address
your suburb, state and country
your current employer and job title
your expected salary and skills
your LinkedIn profile
an "Elevator Pitch" summary we prepare from your interview with Hooker & Heijden

Elevator Pitch uses this to create your profile and will email you to confirm your registration.

Your profile is anonymised for employers: they won't see your name, contact details or anything else that identifies you. Your name and contact details are only released to an employer if you accept that employer's specific connection request. Elevator Pitch's own terms (myelevatorpitch.com.au/terms) apply to your use of the platform.

You can ask Elevator Pitch to remove your profile at any time.

Candidates who register with us in New Zealand are not added to Elevator Pitch, and we don't share New Zealand candidates' information with Elevator Pitch.

Our fees

Hooker & Heijden operates as an introduction business. We may earn a fee or commission from employers or partners when we introduce you, including where the introduction leads to a placement, engagement or referral. We don't charge candidates for placement.

If you don't provide information

If you don't provide the information we ask for, or it's inaccurate or incomplete, we may not be able to represent you or fully consider you for opportunities.

Access, correction and complaints

You can ask to access or correct the personal information we hold about you by emailing contactus@hookerheijden.com.au. We may need to verify your identity. We don't charge for making a request, but may charge a reasonable fee for providing access where the law allows.

If you have a privacy concern, please contact us first and we'll respond within 30 days. If you're not satisfied, you can complain to:

Website information

When you visit our website, we automatically collect technical information such as browser type, operating system, pages viewed, access times and the referring website, using cookies and similar technologies. We use it to understand site traffic and improve your experience. You can manage cookies through your browser settings.

Changes to this notice

We may update this notice from time to time. The current version will always be on this page. We'll ask for your consent before using your information for any new purpose where the law requires it.

Authority to Represent

By submitting a Candidate Registration form, I authorise Hooker & Heijden to:

act on my behalf in finding and securing work, and in supporting my career development
present my resumé and relevant details to prospective employers and clients where my skills and experience may suit a specific or potential opportunity
contact me from time to time about opportunities and to help me find or keep work
contact my referees, and any education, training or professional body, to verify my qualifications, memberships and work history

I understand that Hooker & Heijden will usually discuss an opportunity with me before presenting my details to an employer. I can ask Hooker & Heijden not to present me to specific organisations.

Candidate Declaration

By submitting a Candidate Registration form, I declare and agree that:

The information I've provided is true, accurate and complete to the best of my knowledge. Hooker & Heijden isn't responsible for any false information, omissions or misstatements I have made.
If I don't provide information, or provide insufficient or inaccurate information, Hooker & Heijden may be limited in its ability to represent me. My application may be rejected, or employment ended, if false information, omissions or misrepresentations are later discovered.
If I'm placed in temporary or contract work, I may need to provide bank details, a tax file number (Australia) or IRD number (NZ), superannuation or KiwiSaver details and proof of work rights. With my consent, I may also need to complete a health or medical questionnaire.
I have read and understood this notice.
I consent to Hooker & Heijden collecting, using and disclosing my personal information as described in this notice. My marketing consent, and for Australian candidates my Elevator Pitch consent, is given separately on the registration form.
I consent to Hooker & Heijden collecting sensitive information about me where it's relevant to a role, and understand it will only be used for that purpose.

Withdrawing consent

You can withdraw any consent, including your marketing consent, your Elevator Pitch consent or your authority to represent, at any time. Email contactus@hookerheijden.com.au, or use the unsubscribe link in any marketing message.

Once you withdraw consent, we'll stop using your information for that purpose. If you withdraw consent altogether, we'll delete or de-identify your information within a reasonable time. The exception is anything we must keep by law, such as records of past placements, tax and payroll records.

Withdrawing your Elevator Pitch consent with us stops us sharing further information with Elevator Pitch. To remove an existing profile, ask Elevator Pitch directly. Withdrawing consent won't affect information already given to an employer with your agreement.
